These Terms and Conditions ("Terms") govern your access to and use of shop.subhag.in ("Website") and purchases made through the Website from SUBHAG HealthTech Private Limited ("SUBHAG HealthTech", "we", "us", or "our").
By accessing the Website, creating an account, submitting an enquiry, requesting a demonstration, or placing an order, you agree to these Terms and the other applicable policies published on the Website.
1. Eligibility and Use of the Website
You may use the Website only for lawful purposes and in accordance with these Terms.
If you purchase products or submit an enquiry on behalf of a clinic, hospital, laboratory, company, distributor, or other organisation, you represent that you are authorised to act on behalf of that organisation.
2. Account Registration
Certain Website features may require you to create an account.
You are responsible for providing accurate information and maintaining the confidentiality of your account credentials and OTPs.
You should notify us promptly if you suspect unauthorised access to your account.
3. Product Information
We make reasonable efforts to provide accurate product names, descriptions, images, specifications, pricing, availability, and other product information.
Product images may be illustrative and may vary slightly from the actual product.
Specifications, packaging, accessories, availability, and product configurations may change from time to time due to product updates, manufacturing changes, regulatory requirements, or supply conditions.
4. Medical Devices and Healthcare Products
Products offered through the Website may include medical devices, consumables, kits, laboratory products, and other healthcare-related products.
Depending on the product, certain products may be intended for use by healthcare professionals, clinics, hospitals, laboratories, trained personnel, or other authorised users.
Customers are responsible for using products only for their intended purpose and in accordance with applicable product documentation, instructions for use, labels, warnings, training requirements, and applicable laws and regulations.
Medical devices in India are regulated under the applicable legal and regulatory framework, including the Medical Devices Rules, 2017, where applicable.
5. No Medical Advice
Information provided on the Website is for product, educational, informational, and commercial purposes and is not a substitute for professional medical advice, diagnosis, or treatment.
Customers and healthcare professionals remain responsible for making appropriate clinical decisions and for using products according to their intended purpose and applicable professional requirements.
6. Product Demonstrations
We may provide product demonstrations, online demonstrations, video demonstrations, training sessions, or educational sessions.
A demonstration request does not constitute a purchase commitment or guarantee of product availability.
Demonstration availability may depend on location, product availability, scheduling, personnel availability, and other operational requirements.
7. Quotations
Requests submitted through the Website for quotations are enquiries and do not automatically constitute a binding purchase contract.
A formal quotation may specify product details, quantities, prices, GST, shipping charges, payment terms, delivery terms, installation, training, warranty, validity period, and other commercial terms.
Where a formal quotation is issued and accepted, the terms of that quotation will apply to the relevant transaction to the extent permitted by law.
8. Pricing and Taxes
Prices displayed on the Website may be inclusive or exclusive of applicable taxes, depending on how the price is presented during the purchase process.
Applicable GST, shipping charges, discounts, fees, and other charges will be shown during checkout or communicated through the applicable quotation.
We reserve the right to correct pricing, product, tax, or inventory errors.
If an obvious pricing or product information error affects an order, we may contact you before processing the order or cancel the affected order and provide an appropriate resolution in accordance with applicable law.
9. Booking Amounts and Advance Payments
Where a product or service requires an advance or booking amount, the applicable amount and commercial terms will be communicated during checkout, quotation, booking confirmation, or other applicable documentation.
Where a ₹5,000 booking amount is expressly specified, that amount will ordinarily be treated as an advance against the applicable purchase and adjusted against the final invoice, subject to the applicable order or quotation terms.
The cancellation or refund treatment of a booking or advance payment will depend on the applicable order terms, product status, cancellation circumstances, and applicable law.
10. Placing an Order
When you place an order through the Website, you submit a request to purchase the selected product or products.
An order may be subject to product availability, payment confirmation, address verification, stock availability, shipping serviceability, security checks, and other applicable requirements.
Order acceptance may be communicated through an order confirmation, payment confirmation, dispatch confirmation, or other appropriate communication.
11. Order Cancellation by SUBHAG HealthTech
We may cancel or decline an order where reasonably necessary, including due to:
- Product unavailability
- Incorrect pricing or product information
- Payment verification problems
- Suspected fraud or abuse
- Incorrect or incomplete customer information
- Delivery restrictions
- Regulatory or legal restrictions
- Other circumstances that prevent lawful or practical fulfilment
Where an order is cancelled by us after successful payment and a refund is applicable, the applicable amount will be processed in accordance with our Refund and Cancellation Policy and applicable law.
12. Payment
Payments may be processed through third-party payment gateways, banks, UPI providers, or other authorised payment service providers.
You are responsible for providing accurate billing and payment information.
An order will be treated as successfully paid only after payment confirmation is received through the applicable payment system.
13. Failed Payments
If a payment fails, the order may remain pending, be marked as failed, or require payment to be retried.
If money has been debited but the payment has not been confirmed, the transaction may be subject to reconciliation with the relevant payment provider.
14. Saved Addresses
Where available, customers may save delivery addresses to make future purchases and reorders easier.
You are responsible for ensuring that saved addresses are accurate and up to date.
A saved address does not guarantee delivery serviceability for a future order.
15. Reorders
Where a Reorder or Buy Again feature is available, it creates a new order based on eligible products from a previous transaction.
A reorder is a new transaction. Previous prices, discounts, taxes, shipping charges, payment references, and delivery arrangements do not automatically carry forward.
The current product price, availability, applicable taxes, shipping charges, and terms will apply to the new order.
16. Shipping
Orders may be shipped through Delhivery or another logistics provider selected by SUBHAG HealthTech.
Delivery timelines are estimates unless a specific delivery commitment has been expressly confirmed in writing.
Shipping is subject to product availability, courier serviceability, address accuracy, operational conditions, and other applicable requirements.
Please refer to our Shipping Policy for additional information.
17. Returns, Cancellations, and Refunds
Returns, cancellations, replacements, and refunds are governed by our Refund and Cancellation Policy and any product-specific terms applicable to the order.
Nothing in these Terms is intended to exclude or restrict any mandatory consumer right or remedy available under applicable law.
18. Consumables and Sterile Products
Certain consumable, sterile, sealed, hygiene-sensitive, or otherwise non-resalable products may have restrictions on return after opening, use, contamination, tampering, or removal of protective packaging.
These restrictions do not affect rights or remedies that cannot legally be excluded, including applicable rights relating to defective, damaged, incorrectly supplied, or otherwise non-conforming products.
19. Warranty
Where a product is supplied with a warranty, the applicable warranty terms will be provided with the product, invoice, warranty certificate, quotation, product documentation, or other applicable document.
Warranty coverage may be subject to product-specific terms and may exclude damage resulting from misuse, unauthorised modification, improper installation, negligence, accident, use outside the intended purpose, or normal wear and tear, subject to applicable law.
20. Installation, Training, and Commissioning
Certain equipment may require installation, commissioning, training, site preparation, or technical support.
Where these services are included, the applicable scope will be specified in the product page, quotation, invoice, order confirmation, or service documentation.
Delivery of a product does not automatically mean that installation, commissioning, or training has been completed.

26. Limitation of Liability
To the maximum extent permitted by applicable law, SUBHAG HealthTech will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the use of the Website or third-party services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
27. Privacy
Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.
28. Consumer Rights
Nothing in these Terms is intended to remove, restrict, or waive rights or remedies that you may have under applicable consumer-protection or other mandatory laws.
